Germany has a rather interesting approach to escaping from prison. The basic law, which has been in place since the 1800s, considers it immoral to hinder people’s natural “urge to be free.” Therefore, prisoners can escape from prison, provided they do not commit another crime. However, if escaped prisoners are caught, they are placed in a more secure prison.
In Mexico, according to the Federal Penal Code, a prisoner who escapes from prison is not punished unless he commits another crime. However, if he cooperates with others to escape or commits other crimes, he may be punished.
In the Netherlands, if a prisoner does not escape when he has the opportunity, it is considered self-punishment. That is, if a prisoner does not take the chance to escape, this is considered a negative behavior and is not punished. The approach here is seen as a kind of seizing of opportunity.
Sweden is another country that considers escaping from prison legal. However, there is an important rule here: If no other law is broken, the escape is considered “harmless” and the prisoner is not punished. Additionally, this action is seen as a kind of “enrichment” or opportunity for liberation.

Dr. T. Markus Funk, speaking at the Oxford University Comparative Law Forum, stated that escapes can be legal if they do so without committing another crime. However, he added that this is not easy. Noting that under all circumstances, the only way to escape without committing a crime is to walk, Funk said, “Escaping usually requires care and planning, which is not easy at all.”
